Welcome to FazBrowse. By accessing or using our website ("Site"), services, forums, video hosting features, or any other content or functionality we provide (collectively, the "Services"), you agree to be bound by the following Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Services.

These Terms constitute a legally binding agreement between you ("User," "you") and FazBrowse, its owners, operators, administrators, moderators, contractors, and affiliates (collectively, "FazBrowse," "we," "us," "our").

1. Acceptance of Terms
By using FazBrowse, you affirm that:
- You are at least 18 years of age, OR you are at least 13 years of age and are accessing the Services under the supervision of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf.
- Certain subforums, channels, or sections of the Services are restricted to users 18 years of age or older ("Adult Sections"). By accessing any Adult Section, you represent and warrant that you are at least 18 years old. FazBrowse may, but is under no obligation to, implement age-verification measures, and you agree that self-certification of age constitutes a binding representation.
- You are legally capable of entering into binding contracts under the laws of your jurisdiction.
- If you are using FazBrowse on behalf of an organization, you represent that you have full authority to bind that organization to these Terms, and "you" shall refer to both you individually and that organization.
- All information you provide during registration or use of the Services is accurate, current, and complete, and you will maintain the accuracy of such information.

FazBrowse reserves the right to refuse service, terminate accounts, or restrict access to any person for any reason or no reason, as further described in Section 10.

2. Dispute Resolution, Arbitration, and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

2.1 Informal Resolution
Before initiating any formal dispute proceeding, you agree to first contact FazBrowse at the email listed in Section 18 and attempt in good faith to resolve the dispute informally for a period of no less than thirty (30) days.

2.2 Binding Arbitration
If a dispute is not resolved informally, you and FazBrowse agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services shall be resolved exclusively through final and binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The arbitration shall be administered by a mutually agreed-upon arbitration provider under its rules then in effect, and shall be conducted in [YOUR STATE/COUNTY], in the English language. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

2.3 Class Action and Jury Trial Waiver
You and FazBrowse each waive the right to a jury trial and the right to participate in a class action, class arbitration, or any representative or consolidated proceeding. Claims must be brought in your individual capacity only, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

2.4 Severability of This Section
If any portion of this Section 2 is found to be unenforceable or unlawful, that portion shall be severed, and the remainder of this Section shall continue to apply. If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court rather than arbitration, while all other claims remain subject to arbitration.

2.5 Limitation on Claims
Any claim or cause of action arising out of or related to your use of the Services or these Terms must be filed within one (1) year after such claim or cause of action arose, or it shall be permanently barred, to the extent permitted by applicable law.

2.6 Assumption of Risk
You acknowledge that FazBrowse is provided "as is" and "as available," that you use it entirely at your own risk, and that your sole remedy for dissatisfaction with the Services is to stop using them.

3. Modifications to Terms and Services
FazBrowse reserves the right, in its sole discretion, to modify, amend, or replace these Terms at any time, for any reason. Changes will be posted on this page with an updated "Last Updated" date. We are not obligated to provide individual notice of changes, and it is your sole responsibility to review these Terms periodically. Your continued use of the Services after any modification constitutes your binding acceptance of the revised Terms. If you do not agree to a modification, your sole remedy is to discontinue use of the Services.

3.1 Changes to the Services
FazBrowse reserves the right, at any time and without notice or liability, to modify, suspend, discontinue, or remove any feature, subforum, channel, or other part of the Services, in whole or in part, for any reason or no reason.

4. Intellectual Property

4.1 FazBrowse Content
All content on FazBrowse - including but not limited to text, graphics, logos, button icons, images, audio, video, software, layout, and design - is the property of FazBrowse or its licensors and is protected by copyright, trademark, trade dress, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in such content, except the limited license to view it as part of ordinary use of the Services.

4.2 Restrictions
You may not copy, reproduce, republish, distribute, publicly display, publicly perform, modify, translate, or create derivative works from any part of the Services without FazBrowse's prior explicit written permission. Unauthorized use may result in immediate termination of access and pursuit of all available legal remedies, including statutory and actual damages.

4.3 User-Generated Content License
By submitting, posting, uploading, or otherwise making available any content on FazBrowse - including forum posts, comments, images, videos, usernames, and profile content ("User Content") - you grant FazBrowse a perpetual, irrevocable, worldwide, royalty-free, fully sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content, in whole or in part, in any format or medium now known or later developed, and for any purpose, including commercial and promotional purposes, without further notice to or compensation of you.

This license survives termination of your account or discontinuation of the Services.

4.4 Representations Regarding User Content
You represent and warrant that you own or have all necessary rights to the User Content you submit, and that such content does not infringe or violate the rights of any third party. You are solely responsible for your User Content.

4.5 Retention of Content After Termination
FazBrowse is under no obligation to delete, return, or provide access to any User Content following termination or suspension of your account, and may retain and continue to use such User Content in accordance with the license granted in Section 4.3, subject to FazBrowse's Privacy Policy.

4.6 Trademarks
"FazBrowse," "Ftoob," and all related names, logos, and marks are trademarks of FazBrowse. You may not use these marks without FazBrowse's prior written permission.

5. Prohibited Conduct
You agree not to:
- Use the Services for any unlawful purpose or in violation of any applicable local, state, national, or international law.
- Attempt to gain unauthorized access to any part of the Services, other accounts, or connected systems.
- Interfere with, disrupt, or place undue burden on the Services or connected networks.
- Upload or transmit viruses, malware, or other harmful or disruptive code.
- Use bots, scrapers, crawlers, or other automated means to access the Services without FazBrowse's prior written permission.
- Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
- Post content that is unlawful, defamatory, obscene (outside designated Adult Sections), or that infringes any third party's intellectual property or privacy rights.
- Circumvent, disable, or otherwise interfere with security-related features of the Services.
- Use the Services to harvest or collect information about other users without consent.

Violation of this Section may result in immediate suspension or termination under Section 10, in addition to any other remedy available to FazBrowse under law.

6. Service Availability
FazBrowse may be temporarily or permanently unavailable due to maintenance, updates, technical issues, or factors outside our control. We do not guarantee uninterrupted, timely, secure, or error-free access to the Services, and we are not liable for any downtime, data loss, or inaccessibility, regardless of cause.

6.1 No Obligation to Store or Back Up Content
FazBrowse has no obligation to store, maintain, or back up any User Content, including videos uploaded to Ftoob or files uploaded elsewhere on the Services. You are solely responsible for maintaining your own backup copies of any content you submit. FazBrowse is not liable for any loss, corruption, or deletion of User Content, whether caused by technical failure, server issues, moderation action, or any other cause.

7. Disclaimers
To the maximum extent permitted by applicable law:
- The Services and all content are provided "AS IS" AND "AS AVAILABLE" without warranties of any kind, whether express, implied, or statutory.
- FazBrowse disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
- FazBrowse makes no representation regarding the accuracy, reliability, timeliness, or completeness of any content, User Content, or third-party material accessible through the Services.
- FazBrowse does not warrant that the Services will meet your requirements, or that any errors will be corrected.
- Any material obtained through use of the Services is accessed at your own discretion and risk, and you are solely responsible for any resulting damage, including to your computer system or loss of data.

7.1 No Professional Advice
Any information, discussion, or content on the Services, including in forums such as those used for questions or help topics, is provided for general informational purposes only and does not constitute legal, medical, financial, or other professional advice. You should not rely on any such content as a substitute for consultation with a qualified professional.

8. Limitation of Liability
To the fullest extent permitted by law:
- In no event shall FazBrowse, its owners, operators, affiliates, employees, moderators, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your access to or use of (or inability to access or use) the Services.
- FazBrowse's total cumulative liability to you for all claims arising out of or relating to these Terms or the Services shall not exceed the greater of (a) the amount you paid FazBrowse, if any, in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50.00).
- This limitation applies regardless of the legal theory on which the claim is based (contract, tort, negligence, strict liability, or otherwise), and even if FazBrowse has been advised of the possibility of such damages.
- Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you; in such cases, FazBrowse's liability shall be limited to the greatest extent permitted by applicable law.

9. Indemnification
You agree to defend, indemnify, and hold harmless FazBrowse and its owners, operators, affiliates, employees, moderators, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Services; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of a third party. FazBrowse reserves the right, at your expense, to assume exclusive control of the defense of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with FazBrowse's defense.

10. Termination
FazBrowse reserves the right, in its sole and absolute discretion, to suspend, restrict, or terminate your access to the Services at any time, with or without notice, with or without cause, and without liability of any kind. Grounds for termination may include, without limitation, violation of these Terms, conduct FazBrowse deems harmful to the Services or its users, or extended inactivity. Sections 2, 4, 7, 8, 9, and 18 shall survive any termination of these Terms.

11. Content Moderation and Third-Party Content
FazBrowse allows users to post content and does not pre-screen all User Content. FazBrowse has no obligation to monitor the Services but reserves the right, at its sole discretion, to review, remove, or refuse any content for any reason, without notice. FazBrowse is not responsible for User Content posted by third parties and disclaims all liability related to it, to the maximum extent permitted by law.

11.1 Moderators and Administrators
FazBrowse may designate certain users as moderators or administrators with elevated permissions. Such designations may be granted or revoked at FazBrowse's sole discretion at any time, without notice. FazBrowse is not liable for the actions, statements, or conduct of any moderator or administrator, whether or not such actions were authorized, and reserves the right to remove or reverse any moderator or administrator action.

12. Copyright / DMCA Notice
FazBrowse respects intellectual property rights and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Services infringes your copyright, please send a written notice including: (a) identification of the copyrighted work; (b) identification of the allegedly infringing material and its location; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; (e) a statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature, to the address in Section 18. FazBrowse reserves the right to remove content and/or terminate accounts of repeat infringers.

13. Advertising and Third-Party Links
The Services may display advertisements, sponsored content, or links to third-party websites. FazBrowse does not control and is not responsible for the content, products, services, or practices of any advertiser or third-party site, including any site reached through a link or click-tracking redirect on the Services. Your interactions with advertisers or third-party sites are solely between you and that party, and you agree that FazBrowse is not liable for any loss or damage arising from such interactions.

14. Export Control and Compliance
You represent that you are not located in, and will not access or use the Services from, any country or region subject to comprehensive U.S. government embargo or sanctions, and that you are not on any U.S. government list of prohibited or restricted parties. You agree to comply with all applicable export control and sanctions laws in your use of the Services.

15. Electronic Communications
By using the Services, you consent to receive communications from FazBrowse electronically, including via email, in-site notifications, or postings on the Services. You agree that all agreements, notices, disclosures, and other communications provided electronically satisfy any legal requirement that such communications be in writing.

16. Privacy

17. General Provisions

- Force Majeure: FazBrowse shall not be liable for any failure to perform due to causes beyond its reasonable control.
