Set up a charity

There are 6 steps to setting up a charity.

  1. Find trustees for your charity - you usually need at least 3.

  2. Make sure the charity has charitable purposes for the public benefit.

  3. Choose a name for your charity.

  4. Choose a structure for your charity.

  5. Create a governing document.

  6. Register as a charity if your annual income is over 5,000 or if you set up a charitable incorporated organisation (CIO).

There are different rules in Scotland and different rules in Northern Ireland.

To get tax relief your charity needs to be recognised by HM Revenue and Customs (HMRC).

  7. Step 4 Create a governing document

    The governing document is a set of rules that explains how your charity is run. It needs to include your charity's structure, name and purposes.

  8. Step 5 Make sure you meet the 'public benefit requirement'

    Your organisation must be able to show that it benefits the public.

  9. Step 6 Register your charity

    You must apply to register your charity with the Charity Commission if either:

    • its income will be at least 5,000 per year
    • its a charitable incorporated organisation (CIO)
    1. Register with the Charity Commission

    You can register your charitys details with HM Revenue and Customs (HMRC) to get tax back on things like Gift Aid donations.
