A woman who was raped while she was asleep thought she could have been left pregnant by her attacker. Kyle Plummer, 32, of Mountain Ash, and the victim had attended the same venue in 2023 and had been drinking alcohol.

A sentencing hearing at Merthyr Tydfil Crown Court on Friday heard the pair agreed to walk back to the defendant's home to talk and the victim felt dizzy and lay down for a nap.

After she had fallen asleep the defendant took the opportunity to lie down next to her, remove her trousers and underwear and raped her. She woke up during the incident and told him to get off her, the court heard.

The victim ran out of Plummer's home and didn't wash for three days while undergoing forensic examination after she'd reported the matter to the police.

Plummer, of Rowan Close, denied a charge of rape but he was found guilty by a jury following a trial. The court heard the defendant has no previous convictions but has two cautions for offences including battery.

In a victim personal statement read to the court by prosecutor Laurence Jones the victim said: "When I think about that night I did not agree to it happening.

"I did not agree to anything other than talking. I was made to feel as if it was my fault. I went to the police myself and my medical examination which I found violating and horrible.

"Since it happened I've had a lot of trouble sleeping. I fall asleep, wake up and jump from having flashbacks of what happened and the feeling of pressure on my chest.

"It takes me even longer to get to sleep. I hate to fall asleep all because of something someone else did when I was asleep."

The victim said the rape has affected her new relationship and she would be triggered by being intimate with her new partner.

She added: "What happened affects me every single day. I'm trying so hard to push it to the back of my mind but it gets worse. It's been going on for three years, going over what happened, but it doesn't seem to fix the flashbacks or what happened to me.

"I hate someone else did this to me. I've been trying to speak to people about it but it's hard to talk about or find the words.

"I hate everything that happened, hate it happened to me, I hate him and how it affects my life. I thought I was pregnant following what happened.

"I worried that if I was I would have to make a decision at the start of the pregnancy or it would be a constant reminder. I wasn't part of the decision on whether to use contraception because I wasn't part of the decision to have intercourse."

In mitigation Marian Lewis said her client had spent time living in care as a child and has been diagnosed with autism. The barrister said the defendant was married and his wife has severe mental health issues which has meant they have not been able to live together due to her condition.

Sentencing, Judge Celia Hughes said: "It was clear to me and the jury that you raped her while she was asleep with your penis. You had no care about whether she consented or not.

"You raped her while she was asleep, no doubt disinhibited by alcohol and sexually frustrated as the relationship with your wife was not going well."

Plummer was sentenced to six years and six months imprisonment, made subject to a restraining order for 10 years, and made subject to sex offender notification requirements indefinitely.
