Copyright Policy for FazBrowse

FazBrowse respects the intellectual property rights of others and expects users of our website, forums, video hosting features ("Ftoob"), and any other services we provide (collectively, the "Services") to do the same. This Copyright Policy describes our procedures for addressing claims of copyright infringement in accordance with the Digital Millennium Copyright Act, 17 U.S.C. Section 512 ("DMCA"). This Copyright Policy is incorporated into, and forms part of, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.
1. Reporting Claimed Infringement
If you believe that content available on the Services infringes a copyright you own or control, you (or your authorized agent) may submit a written notification to FazBrowse's Designated Agent identified in Section 6. To be effective, your notification must include, at minimum, substantially the following, as required under 17 U.S.C. Section 512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works;
- Identification of the material claimed to be infringing and information reasonably sufficient to permit FazBrowse to locate it, such as a direct URL or thread/post identifier;
- Your name, address, telephone number, and email address, or other information reasonably sufficient for FazBrowse to contact you;
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the notification is accurate and that you are the copyright owner or are authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
2. Action on Valid Notices
Upon receipt of a notification that substantially complies with the requirements of Section 1, FazBrowse will, in its discretion and as it deems appropriate, remove or disable access to the identified material and will make reasonable efforts to notify the user who posted the material. FazBrowse reserves the right to remove or disable access to any material at any time, with or without a formal DMCA notice, and with or without prior notice to the user, as provided in Section 11 of the Terms of Service.
3. Counter-Notification
If you believe material you posted was removed or disabled as a result of mistake or misidentification, you may submit a counter-notification to the Designated Agent identified in Section 6. To be effective, your counter-notification must include, at minimum, substantially the following, as required under 17 U.S.C. Section 512(g)(3):
- Your physical or electronic signature;
- Identification of the material that has been removed or disabled, and the location at which it appeared before removal;
- A statement, under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification;
- Your name, address, and telephone number; and
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which FazBrowse may be found), and that you will accept service of process from the person who submitted the original notification or an agent of such person.
Upon receipt of a valid counter-notification, FazBrowse may, in its discretion and as permitted by law, forward it to the original complaining party. If FazBrowse does not receive notice that the complaining party has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material within ten (10) to fourteen (14) business days, FazBrowse may, but is not obligated to, restore the removed material.
4. Misrepresentations
Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees, incurred by FazBrowse or the affected user as a result of FazBrowse relying on such misrepresentation.
5. Repeat Infringer Policy
FazBrowse reserves the right, in its sole discretion, to terminate or suspend, without notice, the accounts of users who are determined to be repeat infringers, or who FazBrowse believes, in its sole discretion, to be infringing the intellectual property rights of others, whether or not repeated infringement has been formally adjudicated. FazBrowse's determination of what constitutes a "repeat infringer" for purposes of this policy is final and at FazBrowse's sole discretion.

7. Trademark and Other Intellectual Property Complaints
This policy addresses copyright claims under the DMCA. If you wish to report a claim of trademark infringement or another form of intellectual property infringement not covered by the DMCA, please contact us using the information in Section 6, and include a description of your claim, the material at issue, and your relationship to the relevant right holder. FazBrowse will review such claims at its discretion but is not obligated to act on non-DMCA complaints in any particular manner or timeframe.
8. No Legal Advice; Independent Judgment
This Copyright Policy is provided for informational purposes and does not constitute legal advice. FazBrowse makes independent determinations regarding notices, counter-notices, and removals in its sole discretion, and nothing in this policy obligates FazBrowse to take, or refrain from taking, any particular action with respect to any specific piece of content.
9. Relationship to Terms of Service and Privacy Policy
This Copyright Policy supplements, and is subject to, the Terms of Service and Privacy Policy, including the disclaimers, limitations of liability, indemnification, and dispute resolution provisions set forth therein, which are incorporated herein by reference. In the event of any conflict between this Copyright Policy and the Terms of Service, the Terms of Service shall control.
10. Changes to This Policy
FazBrowse reserves the right, in its sole discretion, to modify this Copyright Policy at any time, for any reason, without prior notice. Changes will be posted on this page with an updated "Last Updated" date. Continued use of the Services after any change constitutes acceptance of the revised policy.
